DD SOFT AI Creative License Agreement

This document is the user and license agreement for creating AI creatives, advertising images, and other visual materials inside DD SOFT products, including Dadam and Dadai. By using image generation, the user confirms acceptance of these terms.

1. Purpose of the service

DD SOFT products help users work with store analytics, products, product cards, reviews, menus, dishes, and advertising materials. The AI creative feature helps users quickly receive variants of advertising images, product card ideas, dish and menu visuals, promotional materials, and visual concepts.

DD SOFT is not a design studio, advertising agency, legal adviser, marketplace moderator, or a service that guarantees ready-to-publish advertising materials. The user decides independently whether to use a generated image in advertising, product cards, menus, social media, messengers, or other channels.

2. AI results may be inaccurate

The user understands and accepts that AI image generation can be unpredictable.

A generated image may:

• not meet the user's expectations;
• not fully reflect the text prompt, source photo, product, dish, brand, color, shape, size, material, or composition;
• contain visual errors, artifacts, and distorted text, logos, packaging, faces, hands, objects, or product details;
• differ from the real product, dish, photo, product card, menu, or advertising idea;
• fail moderation on a marketplace, social network, advertising platform, or other service;
• be unsuitable for a particular commercial, legal, advertising, or reputational purpose.

DD SOFT does not guarantee that an AI image will be accurate, realistic, unique, commercially effective, lawful for a particular use, or compliant with the rules of a specific platform.

3. Rights to the generated image

Unless a separate agreement or tariff states otherwise, DD SOFT does not claim exclusive ownership of an image created by the user through the AI creative feature. To the maximum extent permitted by applicable law, the generated image is provided to the user for use, editing, publication, and commercial use.

The user understands that:

• rights to fully or partially AI-generated materials may be regulated differently in different countries;
• DD SOFT does not guarantee the creation, registration, or protection of copyright in an AI-generated image;
• similar images may be created by other users or other AI services;
• the transfer of rights to the result does not cover source materials, trademarks, images of people, photos, logos, designs, characters, brands, or other third-party objects.

The user grants DD SOFT a non-exclusive technical right to process, store, transmit to technical providers, display, and use prompts, source materials, and generated images to the extent needed to operate the service, support the user, diagnose errors, account for balances, maintain safety, comply with law, and improve service quality.

4. Balance charges and free attempts

If the interface uses a balance, limits, bonus images, free attempts, generation packages, or other accounting, the user agrees that a charge is made for the fact that the service creates an image.

A balance, limit, or free attempt is charged even if:

• the user does not like the image or it does not fit the expected style, color, composition, quality, or meaning;
• the user expected a different result;
• the image requires additional editing;
• the image was not published by the user or failed moderation on an external platform;
• the user deleted the image after creation.

If a request was not technically processed and no image was created due to a DD SOFT failure, the charge may be skipped or restored according to the interface, tariff, or support decision.

5. Image quality is not subject to manual dispute

AI creatives are generated automatically. The service may provide regeneration, prompt editing, style selection, or uploading another source image when such functions are available. However, DD SOFT is not required to manually discuss, edit, redraw, prove the quality of, or replace every generated image.

Statements such as "I do not like it", "the mood is wrong", "I expected another result", or similar feedback do not create an obligation to refund a balance, free attempt, or compensation.

6. Responsibility for source images and photos

The user is solely responsible for all materials uploaded, sent, or used to create AI creatives, including photos of products, dishes, people, interiors, documents, packaging, logos, text, screenshots, brands, and other images.

By uploading source materials, the user confirms that:

• they have the right to use those materials;
• they have obtained required permissions from owners, authors, models, employees, customers, photographers, rights holders, and other persons;
• the materials do not infringe copyright, trademarks, image rights, personal data rights, trade secrets, platform terms, or other third-party rights;
• the materials do not contain illegal, harmful, fraudulent, misleading, discriminatory, offensive, or otherwise prohibited content;
• the materials do not contain confidential documents, bank data, passwords, tokens, one-time codes, or personal documents that should not be sent to an AI service.

If the user uploads a photo of a person, minor, employee, customer, model, public figure, or other third party, the user is responsible for having a lawful basis and consent for processing it and using the resulting image.

7. DD SOFT does not verify source material legitimacy

DD SOFT is not a legal review service and does not verify the origin, authorship, ownership, permissions, licenses, trademarks, model releases, photographer permissions, or legality of every uploaded image.

Technical filters, moderation, or automated safety checks are not legal review, do not guarantee that uploaded material is lawful, do not confirm the user's rights, and do not release the user from responsibility.

8. Prohibited use

The user may not use the service to create, process, or distribute materials that:

• violate law, third-party rights, or platform rules;
• mislead buyers about product properties, contents, quality, origin, price, discount, warranty, or availability;
• imitate official documents, certificates, banking, government, or payment materials;
• unlawfully use third-party brands, logos, characters, photos of people, or protected designs;
• create a false impression of approval, partnership, certification, or involvement of a third party;
• contain prohibited, dangerous, discriminatory, sexual, violent, extremist, fraudulent, or otherwise unacceptable content;
• are used for spam, deception, phishing, unfair advertising, or marketplace rule violations.

9. Use in advertising and on platforms

The user independently checks whether a generated image may be used on a particular platform: Kaspi, a marketplace, Instagram, WhatsApp, an advertising account, website, print material, or another channel.

The user is responsible for:

• the image matching the real product, dish, menu, and offer;
• correct prices, discounts, characteristics, contents, dates, availability, and advertising promises;
• compliance with platform rules and advertising law;
• labeling AI-generated or synthetic content when required;
• obtaining permissions and licenses when the image contains third-party objects, people, brands, logos, or recognizable designs.

DD SOFT does not guarantee publication, moderation approval, sales growth, clicks, conversions, or any advertising result.

10. Storage and processing of materials

DD SOFT may store prompts, source images, generated images, technical events, generation history, generation parameters, charge records, and related user data to the extent necessary for feature operation, history, support, safety, diagnostics, accounting, and legal compliance.

DD SOFT may use third-party technical providers, including AI providers, hosting, storage, analytics, and security services. Data is transferred to such providers only to the extent needed for the feature to work.

11. Limitation of liability

DD SOFT is not liable for user decisions based on generated AI images, publication, advertising use, buyer claims, product card blocking, moderation refusal, third-party rights violations, platform disputes, or losses arising from use of the result.

The user agrees to resolve third-party claims independently if they relate to the user's source materials, prompts, generated images, publication, or commercial use of the result.

12. Changes to these terms

DD SOFT may update this agreement, tariffs, limits, charge rules, technical restrictions, and availability of the AI creative feature. The updated version applies from publication in the app, on the website, or in another interface available to the user unless another date is stated.
